Terms of trade
1.1 All quotes are based on estimates only upon first sighting of clients requested area(s). When the quote is accepted by any means of communication by the client, work shall commence on the agreed date and time by all parties.
1.2 If client requires variations to the quote after the initial sighting is performed, this will need to be agreed and signed to by all parties.
1.3 A quote is valid for 30 days only, unless agreed otherwise.
2.1 - We will complete services requested by client to the best of our ability.
2.2 - After first sighting of job(s) if there are any unrealistic expectations before work commences this will be communicated to client before hand.
2.3 - Client will be made aware of potential damages that may occur when work is being carried out. In some cases some degree of damage may arise without any possible prevention. We will not be liable for damages that cannot be avoided. It will be our obligation to inform the client before / when damage may or may not happen.
2.4 - We will not be liable for defects of the goods provided by customer or third party.
2.5 - We guarantee that we will repair or make good any defects in our Workmanship arising within 12 months following completion of the Services for which the defect is claimed, (“Workmanship Guarantee”) The following conditions apply.
(a) - The Workmanship Guarantee does not apply to the Goods provided (for which the Customer acknowledges clause 2.4 of this agreement applies):
(b) Our liability in respect to the claim raised will only be limited to the labour Value.
(c) - The Workmanship Guarantee does not cover any
occurrence which would normally be covered by public liability insurance or any other form of insurance;
(d) - The Workmanship Guarantee does not apply where alterations or repairs are made by the Customer or any third the party to the Works without the knowledge and prior written consent of the Company (and without the Company first having the opportunity to remedy the same to its satisfaction);
(e) - The benefit of the Workmanship Guarantee is not assignable by the Customer to any other person;
(f) - The Workmanship Guarantee does not apply for so long as the Works have not been completed in full or the Customer is in default in relation to any payment owing to the Company; and
(g) - The Workmanship Guarantee does not apply to any appliance service repair work;
(h) - The Workmanship Guarantee does not cover any loss or damage caused by the matters listed in clauses 2.3 (inclusive);
(i) - The Workmanship Guarantee does not cover any indirect, special, incidental or consequential loss or damage, however caused; and
The Company is not liable to carry out any remedial work under the Workmanship Guarantee unless they receive written notice from the Customer of the claim within seven days after discovery of the defect
2.6 - We are not liable if an outcome expected by you is not achieved.
We give warranties Implied by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
3.1 - All charges for work being done will be specified in quote. This may or may not be limited to full break down of costs.
3.2 - Any Variations and additional expenses charges will be added to quote with clients knowledge, this may be written or verbal.
3.3 - All prices in the quote/invoice are exclusive of GST unless stated otherwise.
3.4 - Clients may be asked to pay a deposit if quotation exceeds $1000, the deposit payment may be a percentage of the quote or only material costing.
3.5 - Special material orders will require a full payment of material cost due to it having a very specific application and not something commonly used. Information if this matter were to arise will be added to quotes and need to be accepted.
4.1 - All payments are to be paid within 7 days of completion of job. Unless agreed otherwise.
4.2 - If deposit is made before work commenced, only the amount owing plus GST will need to be paid for within the 7 days of completion.
4.3 - Payment methods include, cash, online bank transfer, Eftpos terminal on site or Afterpay. Use of Eftpos terminal may occur a surcharge.
4.5 - A 5% charge will be added for every week missed after final due date notice. Client will occur any cost associated with the recovery of payment, this is not limited to Bay Corp, Lawyers and/or court fees.
5.1 - When repair is to be carried out, there must be suitable premises, amenities and access to areas where work is to be commenced, this is not limited to entry into premises, no disruption or obstruction and safe working environment within the work space.
5.2 - Paying the price for work carried out upon this agreement
5.3 - Providing adequate information about repair, site location, and any relevant information for access.
5.4 - Any known Asbestos must be declared by client before entry.
5.5 - Client is required to accept terms of trade before work is commenced. By accepting the quote you accept these terms.
6.1 - Work carried out outside of Whenuapai, Hobsonville, Hobsonville Point, West Harbour, Westgate, Massey, Kumeu, Huapai and Greenhithe may incur a travel charge unless prior agreement.
6.2 - Charge may include: Travel time, fuel, Toll and/or any other associated cost.
6.3 - The client understands that travel outside of these areas may affect arrival times.
